Article 2. Purpose and scope

These terms and conditions govern any distance sale concluded on this website. They apply to consumers within the meaning of the French Consumer Code (Code de la consommation), acting on their own behalf.

We deliver to mainland France and Corsica, to Monaco, to the French overseas departments and territories served, to Belgium, within the European Union, to Switzerland and to a range of international destinations. The up-to-date list of destinations and prices is on the Delivery page.

Placing an order constitutes acceptance of the terms and conditions in force on that date. They may be amended at any time; the applicable version is the one displayed on the day of the order. You can save or print them.

Article 3. Products

The essential characteristics of each item are set out on its product page. The photographs are as accurate as possible but do not constitute a contractual commitment as to the exact rendering of colours, which varies from screen to screen.

Our items are also offered in our shops in Lyon. An item may therefore be sold in store between your order and its preparation. In that case, we do not give up straight away: we contact our network and our suppliers in Italy in order to find the piece in your size. You are kept informed of our search and how long it will take. If the piece still cannot be found, we offer you an equivalent item or a full refund, as you choose.

Article 4. Prices

Prices are shown in euros, including all taxes, excluding delivery charges. For deliveries within the European Union, the applicable VAT is that of the destination country. For Switzerland and destinations outside the European Union, VAT and any customs clearance fees are payable by the recipient on delivery and do not come to us.

The total amount due, including delivery charges, is summarised before the order is finally confirmed.

Article 5. Orders

You check the details of your order and correct any errors before confirming it. Confirmation constitutes acceptance. We acknowledge receipt electronically. The sale becomes final when the dispatch confirmation is sent.

We may refuse an order that is abnormal, clearly placed in bad faith, or placed by a customer with whom a payment dispute is ongoing.

Article 6. Payment

Visa, Mastercard, CB and American Express bank cards, PayPal, Apple Pay and Shop Pay. Depending on the delivery country, local payment methods are also offered (Bancontact in Belgium, for example).

Payment in instalments with Klarna is offered at checkout, at no extra cost provided the instalments are paid on the scheduled dates. The details of the instalments and amounts are shown to you before any confirmation. This facility is subject to Klarna's approval and may not be offered on certain orders.

Payment data is processed in a secure environment by our service providers and is not accessible to us. We do not keep any card numbers.

Your account is debited when the order is placed. If authorisation is refused, the order is cancelled.

Article 7. Delivery

Delivery times, prices and carriers are detailed on the Delivery page. Orders confirmed before 3 pm Monday to Friday are dispatched the same day, subject to availability. We do not dispatch on Saturdays, Sundays or public holidays.

Except in exceptional circumstances, delivery takes place no later than thirty days after the order. After that period, and following a formal notice that has gone unheeded, you may terminate the contract and be refunded within fourteen days.

If the parcel shows any anomaly on receipt, open it in front of the carrier and record precise reservations on the delivery note.

Article 8. Right of withdrawal

You have fourteen days from receipt to exercise your right of withdrawal, without having to give any reason.

To exercise it, inform us by means of an unambiguous statement: from your customer area, by email to contact@pleasefashion-lyon.fr, or by post. You may use the model form reproduced at the end of these terms and conditions.

Send the items back no later than fourteen days after informing us. Return costs remain payable by you. Choose a tracked service: we are not liable for parcels lost during return.

We refund you no later than fourteen days after recovering the items, or after receiving proof of their dispatch if this reaches us first, using the same payment method as that used for the order. The refund covers the price of the items and the standard delivery charges originally paid.

Article 9. Condition of returned items

You may try the items on as you would in a shop. Every garment is delivered with a numbered seal that allows you to try it on; we ask you not to remove it until you are certain you are keeping the piece.

In accordance with Article L221-23 of the French Consumer Code, you may be held liable for any depreciation resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the item. A garment that has been worn, washed, stained, damaged or is missing its original labels gives rise to a deduction proportionate to the loss of value.

Pack the parcel carefully. Do not use an item's box as a shipping parcel: it is part of the product. Please protective pouches must be returned; failing this, €5 is deducted per missing pouch.

Article 10. Exchanges

Independently of the right of withdrawal, we accept exchanges within fourteen days of receipt, subject to stock availability. Give "exchange" as the reason, stating the size or colour you would like. Outbound and return shipping costs remain payable by you. In the shop, exchanges are possible on presentation of the invoice.

Article 11. Legal guarantees

All our items benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

The guarantee of conformity applies for two years from delivery. You choose between repair and replacement, and you are exempt from proving the existence of the defect during these two years. It applies independently of any commercial guarantee.

The guarantee against hidden defects allows you to obtain cancellation of the sale or a price reduction, within two years of discovering the defect.

If an item is faulty or non-conforming, contact us before sending anything back. The return and re-shipping costs are then borne by us.

Article 12. Complaints and consumer mediation

For any complaint, write to us at contact@pleasefashion-lyon.fr or call 04 78 85 69 32. We undertake to reply within fifteen days.

In accordance with Articles L612-1 et seq. of the French Consumer Code, if your written complaint has not led to a satisfactory solution, you may refer the matter free of charge to the consumer mediator to which we belong:

CM2C
49 rue de Ponthieu, 75008 Paris
Telephone: 01 89 47 00 14
Website: www.cm2c.net/declarer-un-litige.php
Email: litiges@cm2c.net

The matter may only be referred to the mediator if you have first sent us a written complaint, and within one year of that complaint. Mediation is free of charge for the consumer and does not preclude bringing the matter before the courts.

Article 13. Personal data

The data collected is necessary to process your order, manage your account and, with your consent, send you our commercial information. The data controller is BOUTIQUE 2.

In accordance with the General Data Protection Regulation and the French Data Protection Act (loi Informatique et Libertés), you have the right of access, rectification, erasure, restriction, objection and portability. You may exercise these rights at contact@pleasefashion-lyon.fr or by post to the registered office. You may lodge a complaint with the CNIL.

You can unsubscribe from our mailings at any time using the link in each message.

Article 14. Cookies

This website uses cookies that are necessary for it to function, as well as audience measurement cookies and, where applicable, advertising personalisation cookies. You set your choices on your first visit and can change them at any time.

Article 15. Intellectual property

The trade marks, texts, photographs and graphic elements of the website are protected. Any reproduction or use, in whole or in part, without prior written authorisation, is prohibited.

Article 16. Force majeure

Our obligations are suspended in the event of force majeure. If the impediment continues for more than fifteen days, you may terminate the order and be refunded.

Article 17. Applicable law

These terms and conditions are governed by French law. If you reside in another member state of the European Union, you retain the benefit of the more protective mandatory provisions of your country of residence.

In the event of a dispute, an amicable solution will be sought first, in particular through the mediation provided for in Article 12.
